1. INTRODUCTION

Welcome to Omilía Therapist (“the App”), provided by Happy Path Apps, LLC. (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the App, including all services, features, and content offered through it. By creating an account or otherwise using the App, you agree to be bound by these Terms.

2. DESCRIPTION OF THE APP

Omilía Therapist is designed for licensed or qualified speech therapists (“Therapists”) to:

  1. Assign homework and baseline evaluations to their patients.

  2. Monitor patient progress and statistics.

  3. Create custom content that appears in their patient’s Omilía app.

  4. Update patient app settings to tailor therapy sessions.\n\nTherapists can connect with patients via an email invite or by providing a QR code for the patient to scan. The patient must confirm the connection request before data sharing begins.

3. USER ACCOUNTS

Eligibility: You must be at least 18 years old and legally capable of entering into contracts to use the App as a Therapist.

Account Information: You agree to provide accurate, current, and complete information during account registration and to update it promptly if it changes.

Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. THERAPIST-PATIENT CONNECTION

Invitation: Therapists can send an email invite or provide a QR code for Patients to connect.

Patient Confirmation: A Patient must confirm the connection before any data sharing or interaction can occur.

Data Access: Once connected, Therapists can access certain patient data, including:

  • Patient name

  • Patient game scores and history

  • Patient app settings

  • Patient profile picture

Therapists must use this data solely for speech therapy purposes and in compliance with applicable privacy and healthcare regulations.

5. ACCEPTABLE USE

You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the App to collect or store information beyond what is necessary for speech therapy.

  • Engage in any activity that disrupts or interferes with the App’s operation or security.

  • Reverse-engineer, modify, or create derivative works of the App without express permission from Happy Path Apps, LLC

6. INTELLECTUAL PROPERTY

All content, trademarks, service marks, and software within the App are the property of Happy Path Apps, LLC. or its licensors. You are granted a limited, non-exclusive, revocable license to use the App for its intended purpose. You may not copy, reproduce, distribute, or create derivative works of any content without prior written consent.

7. PRIVACY

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect personal information. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

8. DATA AND PATIENT CONFIDENTIALITY

Therapists are responsible for handling patient data in compliance with all applicable privacy and healthcare laws (e.g., HIPAA, GDPR, or local equivalents). We disclaim all liability arising from unauthorized use or disclosure of patient data by Therapists.

9. DISCLAIMER OF WARRANTIES

The App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or secure, or that any defects will be corrected.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, [Your Company Name] shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability for any claim arising out of or relating to the App shall not exceed the amount paid by you, if any, to use the App.

You agree to indemnify and hold Happy Path Apps, LLC. harmless from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another.

12. MODIFICATIONS TO THE TERMS

We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes by posting an updated version in the App or via email. Your continued use of the App after such modifications constitutes acceptance of the revised Terms.

13. TERMINATION

We may terminate or suspend your access to the App at any time, without prior notice or liability, if you breach these Terms or engage in any conduct that we deem inappropriate or unlawful.

14. GOVERNING LAW
